Article 1

Unless expressly agreed in writing, the present terms and conditions apply to any sale of products or services from CUBE Belgium, including membership of the association and the organization of events, seminars, training courses, etc. (hereinafter referred to as “the events”). These conditions take precedence over all other conditions, including those imposed by other parties.

Article 2

The prices do not include VAT, or any other tax, or transportation. The prices are indexed annually, in January or in July as the case may be, in the amount of 80%, the reference index being the evolution of salaries of the Joint Committee No. 200, according to the following formula:

Indexed price = BP x 0,8 x NI + BP x 0,2

BI

BP = base price of the contract

BI = index of year and month signing contract

NI = new index of the new year and of the month prior to the indexation of the contract

CUBE invoices are payable within 30 days of the invoice date. In the event of non-payment by the due date, the amount still due shall, ipso jure and without prior notice, bear interest at a rate of 1% per month. In the same circumstances, the amount still due shall also be increased by 10% with a minimum of €50.00. If CUBE’s invoices are to be addressed to a third party at the Customer’s request, payment shall be guaranteed by the Customer.

Article 3

A membership with CUBE has a duration of 1 year. By default, membership runs from April to April the following year.

Article 4

Membership is tacitly renewed for successive one-year periods unless notice is served by registered mail no later than three months prior to the March 31 expiration date.

Article 5

Any registration for an event organized by CUBE whose admission is paying shall give rise to payment of the amount due, even in the event of cancellation or non-attendance at the event in question, except in the case of other specific conditions stated for the event in question.

The registered participant may be replaced by another person, unless this is expressly prohibited for the event. The participant will owe the amount corresponding to the membership category to which he or she belongs.

CUBE cannot be held responsible in case of modification of the event program (speaker, time, subject…) insofar as this modification occurs for reasons beyond its control.  The speakers are solely responsible for the content of their respective communication

Article 6

The commitments on the part of CUBE are obligations of means. Damages payable by CUBE shall not exceed the price of the performance under dispute. Any complaint concerning the delivery or service performed must be made in writing to CUBE within 15 days of the performance or delivery. For complaints regarding invoices, a period of 1 month from the invoice date shall apply. Complaints brought to CUBE’s attention after these deadlines shall not be considered. CUBE is entitled to refuse a membership or a sale of a product or a service

Article 7

Current general terms and conditions is subject to Belgian law. Any dispute will be settled exclusively by the courts of Brussels.

Article 8

Invoice received by e-mail is legally valid (accepted by the tax authorities) and, consequently, receiving an invoice by mail is no longer required.
